Communicating in simple language is a simple solution to the complex world of communication: Kuldeep Singh Bais

Question: In your own words what is the biggest challenge of public relations professionals across the country in the contemporary world?

Ans: If I have to summarise the complexities of the communication arena in one sentence then I would say “ The majority of Communication professionals are struggling to get extraordinary results out of their content”. Communication professionals are not able to reach out to a larger audience through their content because of the complex language they produce quite often. In my view ideal communication should be direct and easy to understand, unfortunately, many communication professionals are unknowingly producing complex content by putting more creative thoughts or unusual vocabulary instead of a direct and simple message. The language of communication must be simple so that it should be easy to understand and grasped by a large number of people instead of a selected few. Communicating in simple language is a simple solution to the complex world of communication.

Question: You have spent around 16 years in journalism and now you are handling media relations and external communication at a steel giant. Share your thoughts: what are the key elements of effective communication?

Ans: An effective communication must be concise, to the point, should be easy to understand, and have a direct message to the audience. The moment you lose the grip over the content you lose the momentum and the key message too. These elements are applicable to all forms of communication written, visual, verbal everywhere. If the content has weightage then there is no need to give more weightage to content through heavy words or other effects.

Question: How has digital media changed the strategy of communication in the corporate world?

Ans: Digital Media is leading the communication space. Undoubtedly people are spending more time over social media platforms other than the traditional mediums like newspapers and television. Twitter has become the primary source of News in India, similarly Facebook and Instagram are leading the video content and reaching a bigger audience. The revolution came over the past decade. The 2014 General elections have revealed that campaigns through social media can do wonders. The corporate world is also focusing and spending more on digital platforms. The reach of social media is phenomenal and response time is also less. Mapping the diversified audience is also much easier than the traditional mediums, you have dashboards available to listen to who is talking about you and your brand, and based on this social media listening corporates are reading the minds of investors, employees, customers, and other stakeholders. Corporations are getting leverage of this and becoming more relevant to the audience.

Question: A trend of decline in Newspapers readership has been seen after the introduction of TV & Social Media. How relevant do you think newspapers will be in the next decade?

Ans: In my opinion, newspapers are still relevant and will remain relevant in the next decade also. Yes, they took a hit in recent years due to the emergence of social media platforms and relatively cheaper internet space and more specifically during the pandemic but their importance is still there because of the detailed content they publish. In India, if you want to understand some issue or news, you still trust newspapers because they publish detailed information and attractive infographics. Reading newspapers is still a primary source of news in remote areas of India because digital media and television are still struggling to make an imprint over the newspapers. The evolution of broadband in rural areas may become a problem for newspapers especially for native language readers and regional readers but I don’t see any tectonic impact on newspapers as these organizations are also changing strategy to become more relevant, you have epapers and whats app-friendly version of Printed news which is making a difference.

Question: Do you consider Public relations to be an alternate career for journalists? How do you feel about them competing with the core communication professionals?

Answer: I am enjoying working with a corporate house, I am learning a lot of every day as one has to always be ready to learn. The communication space is rapidly changing, every year new technology and updates are coming in and this is evolving a sense of learning in me. I personally believe that a true journalist will always remain a journalist even if he is not working for a publishing house or a broadcasting company. As the name suggests Public relations is a wider phenomenon and it has a lot to explore if you are ready to learn and implement the effective communication strategies learned over the years.

To bring back 39 Indian sailors, Naveen Jindal offers to buy coal shipment stranded in Chinese water

Industrialist Naveen Jindal has shown his support to bring back 39 Indian sailors stuck at the Chinese border. Taking on Twitter, Jindal writes, “This is a humanitarian crisis: 39 Indian sailors stranded at Chinese ports for months; were carrying coal from Australia to China. We are ready to buy the coal on these ships if it can help bring our sailors back home.”

According to an official of the National Union of Seafarers of India (NUSI), 39 Indian sailors are stuck in the Chinese waters on two merchant ships for three to seven months, because of deteriorating China-Australia ties. They are being counselled for severe mental distress. It is due to the ongoing “trade war” between China and Australia that leads to the trouble for Indian sailors.

In support to rescue these sailors, Chairman of Jindal Steel & Power Naveen Jindal has taken a bold step by offering to purchase the coal in that shipment. It is however, on the Australian authorities if they agree to the offer. Jindal has also tagged the officials from the Ministry of External Affairs, Government of India to intervene in the matter.

Demystifying FinCEN: Why It’s Much Ado About Nothing Much

Fincen files
Fincen files

The recent reports on SARs (Suspicious Activity Reports) on Sept 23, 2020 published in some newspapers, based on the illegally-leaked FinCEN data by ICIJ (International Consortium of Investigative Journalists) etc., have created an unwarranted negative sentiment in the market during these trying times of COVID-19 pandemic.

The first question that arises is whether any cognizance of the data, illegally leaked, should be taken at all.

It’s a known fact that leaking FinCEN data or revealing the details of a SAR filing is a criminal offense in USA under the Bank Secrecy Act 1970 (BSA) which can result in a fine of up to $250,000 and five-year jail term for each offense.

FinCEN issued a statement last month on the unauthorized disclosure of SARs and referred the matter to the US Department of Justice and the US Department of the Treasury’s Office of Inspector General for initiating necessary action.

While it remains debatable whether various enforcement agencies in India or worldwide can legally initiate enquires based on these very sketchy and illegally-obtained data published in newspapers, perhaps, with a view to score some brownie points, without having any clear understanding of what the data actually connote, some repetitional damage to most of the large Indian companies has already been done.

I sincerely hope that these sketchy, half-baked media reports aren’t cited as credible, authoritative pieces of investigative journalism, warranting action or enquiries against those whose names are featured in the media reports.

It’s, therefore, necessary to clear the air surrounding SARs / FinCEN.

SAR or Suspicious Activity Report is a document filed by Banks, Money Exchange Agents, Security Brokers, Financial Institutions and even Casinos to report suspicious looking financial activities to FinCEN within 30 days from the date of any transaction. SARs are neither accusations nor can they be cited as evidence of criminal conduct or any other financial misconduct. They cannot be used as evidence in any court of law.

It’s interesting to note that there is absolutely no onus on part of the reporting entities to prove that the transactions reported under SARs are indicative of financial irregularities or any misconduct.

However, non-reporting makes them liable for imposition of heavy fines or even incarceration of the concerned officials.

Given this situation (30 days’ time period for reporting; no responsibility for the authenticity of the data reported; and heavy fines for non-reporting), eligible reporting agencies in US and elsewhere choose the easier way: they report all such transactions (they report over 2 million every year only in US alone) which even remotely look suspicious without going into any details. For example, if a manufacturing company is exporting merchandise for a certain value and also importing raw materials for a value similar or closer to the export value within a given period of time then from a reporting agency’s perspective, both the transactions will be treated as ‘round tripping’ and will fall within the ambit of SAR.

Such transactions may actually be totally innocuous and business-driven, but because of a faulty reporting system, such transactions, more often than not, get reported to FinCEN.

An irony indeed, but that’s the way it is.

While this looks bizarre on one hand, on the other hand the account holder remains absolutely oblivious of the fact that the transactions undertaken in the usual course of business through his account are under FinCEN scrutiny until the time such data are stolen, sensationalized and put into the public domain by some newspapers which may be having vested interests. Left to FinCEN, most of these data will not warrant any investigation, filed as they are in a routine manner.

Had this not been the case, FinCEN, in so far as India is concerned, may have reported these 4–5-year-old transactions, mentioned and sensationalized by newspapers to FIU-IND (Financial Intelligence Unit — India), the counterpart of FinCEN in India, which was set up in 2004 under the Ministry of Finance to deal with such transactions appropriately.

I am of the reasoned opinion that there was no such reporting by FinCEN to FIU-IND on the said transactions. FinCEN probably didn’t find anything really wrong or perhaps worth pursuing with the Indian enforcement agencies on these transactions. Some transactions, however, showing serious financial misconduct like Augusta Westland, Maxis Communications etc. are already being investigated by various Govt. Agencies.

It’s now time for the Union Government to take a balanced, reasonable view, avoiding any kneejerk reaction in the process.

Our respected Prime Minister has also repeatedly said that wealth creators need to be respected and encouraged.

When the corporates are working overtime adding to the governmental efforts towards an economic recovery in India, nothing adverse should be done based on the unauthentic and illegally leaked data until and unless there are prima-facie compelling evidences of serious financial misconduct. Otherwise it may result in slowing down the economic recovery process during these trying times.

It may also not be appropriate to even remotely presume at this point of time that people or companies whose name featured in FinCEN indulged in any illegal financial activities.

Truth could be just the contrary.

It’s worthwhile to mention here that even the reporting entities are not required to keep the details of the financial transactions reported to FinCEN after a period of 5 years. But the companies in India now (even after 5 years) may have to go through the travail of this reporting of the illegally obtained data which could see enforcement agencies raising queries with the companies named by these newspapers.

All such companies will have to dig out their archived data base and retrieve all the relevant documents to show that all the exports / imports and various other business transactions undertaken by them several years ago had proper and defined underlying. What a colossal waste of time on the part of both — enforcement agencies and companies.

Let’s pause for a moment here and look at the enormity of the leaked data. Stolen data pertain to the period 1999–2017, total number of SARs — 2121 (this is just the tip of the iceberg), aggregate transacted amount — USD 2.099 trillion, No. of banks reporting these transactions — 6 (Deutsche Bank, SCB, BONYM, JP Morgan, Barclays and HSBC). The volumes are indeed huge, but all these are financial transactions (though some may be dubious as well). The real dirty money which gets transferred from US to various countries worldwide and vice-versa to carry out subversive activities in foreign lands, however, never gets reported.

Government agencies always focus on business and commercial transactions, and what is disquieting is that because of a few unscrupulous persons and business entities, others also have to face the brunt and wrath of various agencies.

This needs to be factored, and the agencies need to adopt a balanced, and fair approach so as to avoid panic reactions in the market.

Most industries are under immense pressure already. Any undue pressure further on them will prove debilitating.

Corporates are always easy targets. In these trying times, it’s in the interest of all stakeholders of the economy that reason, sense of fair play, and sense of proportion be kept in mind before arriving at any conclusion.

So, what’s the way out? In my opinion, if any cognizance has to be taken of the stolen FinCEN data published in the newspapers, then a minimum threshold limit should be first fixed for scrutinizing the financial transactions, and the same can be, say, a minimum amount of USD 25 million.

Only the transactions above this threshold, should randomly be picked, analyzed and further details, if needed, can be had from the concerned companies. In other words, the focus should be on the relatively larger transactions and if any evidence of wrongdoings is found, then other transactions of smaller values may also be taken up for scrutiny, and further investigations. This will save time and money for both — government agencies and the corporates. This will provide comfort to the companies which have not indulged in round-tripping and / or any other illegal financial transactions.

In these trying times, when the Govt. is trying to extend all possible help to business enterprises, otherwise struggling to stay afloat, any witch-hunting, or selective targeting, by the enforcement agencies based on these illegally-obtained data must be avoided.

This is the time to focus on productive activities to strengthen the country and economy, and not encourage anything that weakens the national resolve.

JSPL denies charges and allegations over Coal block allocation

Jindal steel and power today issued an official statement over media reports published yesterday on the framing of charges against Naveen Jindal & others with respect to coal block allocation.

JSPL issued official statement and denied charges and allegations over coal block allocations.

Here is the official statement of Jindal Steel & Power.

JSPL categorically deny the charges and allegations and reiterate that our Company has done no wrong and we are confident that the truth will emerge during the course of the judicial process/trial, vindicating our stand.

The allegations made against the company and individuals are misconceived and frivolous in nature. It is pertinent to mention here that basis of allocation of a coal block in question was the existing and proposed blast furnace capacity of the plant at Chhattisgarh, qua which there is no allegation of any misrepresentation. The very foundation of the CBI charge sheet is faulty as the Screening Committee, on suggestion of the administrative ministry i.e. Ministry of Steel, and agreed by all the members of the Screening Committee, had decided to recommend allocation of Urtan North Coal Block to JSPL in view of its existing blast furnace capacity of 1.5 MTPA plant at Chhattisgarh.

Further, all allegations qua less acquisition of land for Patratu, Jharkhand plant and placing of orders for equipment for less value for Angul, Orissa plant are misconceived as the company had acquired the land for the area and placed the orders for equipment for the value more than, what was mentioned before screening committee, much before actual allocation. Further, bonafide of the company is apparent from the fact of commissioning of
6 mtpa Angul plant in Odisha at an investment of over Rs 33000 crore.  JSPL’s Angul steel making complex is the largest and most modern integrated steel plant in the state of Odisha.

Thus, it is a frivolous case of CBI where the charge is not made out for the offences as alleged by the CBI.

JSPL has always maintained high standards of corporate governance and always abide by the law of the land. We have full faith in our judiciary that justice will be done.

JSPL has been at the forefront of successfully creating and operating large infrastructure projects in the Steel & Power sectors by investing over Rs. 1 Lakh crore; and has generated economic activity of over Rs. 4 lakh crore. Also paid over 40k crore in taxes. Being amongst the highest value creators and employment generators in India, JSPL today employs a workforce of over 1, 00,000 and anchors a socio-economic ecosystem of 2 lakh families.
